Service Description

Brand Muse is a creator analytics and strategic intelligence platform that helps content creators and brands understand performance across social media platforms. We connect to your social media and e-commerce accounts to display your profile information, statistics, and content data in an organized analytics dashboard, and provide AI-powered strategic recommendations.

Current Platform Integrations

Brand Muse currently integrates with TikTok, Instagram (via Facebook Login for Business), YouTube, X (formerly Twitter), and Shopify. You may connect one or more of these accounts to access analytics, owned-content dashboards, and strategic insights.

What We Do

  • Display your social media profile information
  • Show your performance statistics across connected platforms
  • Analyze your public content
  • Calculate performance metrics based on your content
  • Provide insights into your audience engagement
  • Provide AI-powered strategic recommendations and chat-based analysis using third-party AI model providers (Anthropic and Google)
  • Track ROI and attribution through connected e-commerce platforms (Shopify)
  • Facilitate creator discovery through third-party creator intelligence providers

What We Do NOT Do

  • Share your data with other users or third parties (except service providers acting on our behalf as described in our Privacy Policy)
  • Use your data to train AI models for other users
  • Sell your data
  • Access any private or non-public information beyond what you explicitly authorize

Independence

Brand Muse is an independent service and is not affiliated with, endorsed by, or sponsored by TikTok Inc., YouTube LLC, Instagram LLC, Meta Platforms Inc., X Corp., Shopify Inc., or any other social media or e-commerce platform.

Eligibility

You must be at least 18 years old to use Brand Muse.

By using Brand Muse, you represent and warrant that you are at least 18 years of age and meet this age requirement.

Account Registration and Security

Account Creation

To use Brand Muse, you must:

  • Create an account with a valid email address
  • Maintain accurate account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access

Platform Account Connections

To access analytics features, you must:

  • Have valid accounts on the social media or e-commerce platforms you wish to connect
  • Grant us permission to access specific information via each platform's authorization process
  • Comply with each platform's Terms of Service and applicable policies

You can revoke our access to your platform data at any time through the respective platform's app settings or through your Brand Muse account settings.

TikTok Integration

TikTok Data Access

When you connect your TikTok account to Brand Muse, you authorize us to access the following information through TikTok's API:

user.info.basic - Basic profile information including:

  • Open ID and Union ID
  • Avatar URLs
  • Display name

user.info.profile - Extended profile information including:

  • Profile links
  • Bio description
  • Verification status

user.info.stats - Performance statistics including:

  • Follower count
  • Following count
  • Likes count
  • Video count

video.list - Your public videos including:

  • Video metadata (title, description, publish date)
  • Video performance metrics
  • Public engagement data

TikTok-Specific Terms

  • You must comply with TikTok's Terms of Service and Community Guidelines
  • You acknowledge that TikTok data is owned by TikTok Inc.
  • You can revoke TikTok access at any time via TikTok Settings → Security → Manage Apps
  • We will stop accessing new TikTok data immediately upon revocation

Instagram Integration

Instagram Data Access

When you connect your Instagram account to Brand Muse via Facebook Login for Business, you authorize us to access the following through Meta's APIs:

  • Instagram Business or Creator profile (username, profile picture, follower counts, media count)
  • Your media posts and associated engagement metrics (likes, comments, saves, shares, plays, impressions, reach)
  • Account-level and media-level insights for analytics and recommendations
  • The Facebook Page linked to your Instagram Business account (ID and name), only to establish the connection

Instagram-Specific Terms

  • You must use an Instagram Business or Creator account linked to a Facebook Page where required by Meta
  • You must comply with Meta's Platform Terms, Facebook Terms, and Instagram Terms
  • You acknowledge that Instagram and Facebook data is owned by Meta Platforms, Inc.
  • You can revoke Instagram access at any time via Meta/Facebook settings (Business Integrations) or Brand Muse Settings → Integrations
  • We will stop accessing new Instagram data immediately upon revocation
  • We support Meta's Data Deletion Callback; you may request deletion of your Instagram-related data through Meta's process

YouTube Integration

YouTube Data Access

When you connect your YouTube channel to Brand Muse, you authorize us to access the following information through Google's OAuth 2.0 and the YouTube API:

  • Channel profile information (name, description, profile picture, subscriber count)
  • Channel statistics (total views, video count, subscriber count)
  • Video metadata (titles, descriptions, publish dates, thumbnails)
  • Video performance metrics (views, likes, comments, watch time)
  • YouTube Analytics data (traffic sources, audience retention, subscriber changes)

YouTube-Specific Terms

  • You must comply with YouTube's Terms of Service and Community Guidelines
  • You acknowledge that YouTube data is subject to Google's Terms of Service
  • Our use of YouTube API data complies with Google's API Services User Data Policy, including the Limited Use requirements
  • You can revoke YouTube access at any time via Google Account → Security → Third-party apps with account access, or Brand Muse Settings → Integrations
  • We will stop accessing new YouTube data immediately upon revocation

X (Twitter) Integration

X Data Access

When you connect your X (formerly Twitter) account to Brand Muse, you authorize us to access the following information through X's OAuth 2.0 API (with PKCE):

  • Your user ID and username via the users.read scope
  • Read access to your posts via the tweet.read scope

We request offline.access to maintain your connection without requiring repeated authorization.

X-Specific Terms

  • You must comply with X's Terms of Service and Rules
  • You acknowledge that X data is owned by X Corp.
  • You can revoke X access at any time via X Settings → Security and account access → Apps and sessions, or Brand Muse Settings → Integrations
  • We will stop accessing new X data immediately upon revocation

Shopify Integration

Shopify Data Access

When you connect your Shopify store to Brand Muse, you provide us with your store URL and API credentials, which we use to access:

  • Store identification (store URL, store name)
  • Order data (order IDs, revenue totals, order dates, currency, attribution source)

Shopify-Specific Terms

  • You must have authorization to connect the Shopify store you provide
  • You acknowledge that Shopify data is subject to Shopify's Terms of Service
  • Your Shopify API credentials are stored in encrypted form
  • You can disconnect your Shopify store at any time via Brand Muse Settings → Integrations
  • We will stop syncing new order data immediately upon disconnection

AI-Powered Features

Use of Third-Party AI Providers

Brand Muse uses third-party AI model providers (currently Anthropic and Google) to power its AI strategist chat and related features. When you use these features:

  • Your chat messages, conversation history, and relevant account context (such as brand profile and campaign information) are sent to these providers to generate responses
  • These providers act as data processors and do not use your data to train their models
  • AI-generated recommendations, insights, and analysis are provided for informational purposes and should not be treated as professional consulting, financial, or legal advice
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content

Your Responsibilities

  • You are responsible for evaluating and verifying AI-generated recommendations before acting on them
  • You should not rely solely on AI-generated content for business-critical decisions without independent verification

Acceptable Use

You agree NOT to:

  • Use Brand Muse to violate any connected platform's Terms of Service or applicable policies
  • Attempt to access other users' data or accounts
  • Use automated tools to scrape or extract data from Brand Muse
  • Misrepresent yourself, your content, or your performance metrics
  • Use the service for any illegal purpose
  • Reverse engineer or attempt to derive the source code of Brand Muse
  • Interfere with or disrupt the service or servers
  • Transmit any viruses, malware, or harmful code
  • Use the service to harass, abuse, or harm others

Your Data and Privacy

Data Ownership

Your social media and e-commerce data belongs to you and the respective platforms. We store your connected platform data (TikTok, Instagram, YouTube, X, Shopify) in an isolated account that only you can access. This includes profile information, statistics, content metadata, order data, and analytics data, which are stored to provide you with dashboard and analytics features.

Our Commitments

We do not:

  • Share your data with other Brand Muse users
  • Combine your data with other users' data for aggregate analytics
  • Use your data to train AI models that serve other users
  • Sell your data to third parties
  • Use your data for advertising purposes

Data Control

You can delete all your data at any time by deleting your Brand Muse account. For complete details on data handling, see our Privacy Policy.

Intellectual Property

Your Content

  • Your social media content remains yours
  • You retain all ownership rights to your content
  • Social media data is owned by the respective platforms

Brand Muse Property

  • Our proprietary analytics algorithms, scoring methods, and user interface are owned by Brand Muse
  • The Brand Muse name, logo, and trademarks are our property

Limited License

You grant us a limited, non-exclusive license to process your social media and e-commerce data solely to provide the Brand Muse service to you. This license terminates when you delete your account or revoke platform access.

Account Termination

Your Right to Terminate

You can delete your account at any time through your account settings. When you do:

  • We will delete all your connected platform data (TikTok, Instagram, YouTube, X, Shopify: profile information, statistics, content metadata, order data, and analytics) within 30 days
  • We will delete AI chat history and conversation data within 30 days
  • We will delete usage and decision-making data we store (e.g. how you use the product and choices you make) within 30 days
  • Your access to Brand Muse will be immediately terminated
  • We may retain minimal records for legal compliance purposes (such as email address for anti-fraud measures)

Our Right to Terminate

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Abuse the service or harass other users
  • Fail to comply with connected platform policies

We will provide notice of termination when possible, but reserve the right to terminate immediately for serious violations.

Disclaimers and Warranties

Service Provided "As Is"

Brand Muse is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability

No Guarantees

We do not guarantee:

  • Accuracy of social media data (we display what platforms provide)
  • Uninterrupted or error-free service availability
  • That our metrics perfectly predict future performance
  • That the service will meet all your requirements
  • That all bugs or errors will be corrected

Third-Party Services

We are not responsible for the availability, accuracy, or reliability of data provided by TikTok, YouTube, Instagram, X, Shopify, or any other third-party platform or service, including AI model providers.

Limitation of Liability

To the maximum extent permitted by applicable law, Brand Muse and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the service
  • Any unauthorized access to or use of our servers or your personal information
  • Any interruption or cessation of transmission to or from the service
  • Any bugs, viruses, or harmful code transmitted through the service
  • Any errors or omissions in content
  • Any third-party conduct or content on the service

Our total liability to you for all claims arising from or relating to the service shall not exceed the amount you paid us in the twelve months prior to the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Brand Muse and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service
  • Your use of the service
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you by:

  • Email to your registered email address
  • In-app notification
  • Notice on our website at least 30 days before the changes take effect

Your continued use of Brand Muse after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the service and may delete your account.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at admin@brandmuseagency.com. We will attempt to resolve the dispute informally within 60 days.

Arbitration

If we cannot resolve the dispute informally, you and Brand Muse agree to resolve any claims through final and binding arbitration, except as set forth below. The arbitration will be conducted by a single arbitrator and will take place in the county where you reside or another mutually agreed location.

Exceptions to Arbitration

Either party may bring a lawsuit in court for:

  • Injunctive relief
  • Intellectual property disputes
  • Small claims court matters

Class Action Waiver

You and Brand Muse agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class action, consolidated action, or representative action.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Brand Muse regarding the use of the service and supersede any prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
